The Austrian system of protection of fundamental rights is more integrated into the European system than many other legal orders. This stems from the traditional structure of the Austrian constitution of 1920, which does not have its own catalogue of fundamental rights. In the course of ever closer European integration, a system of protection has therefore developed that is based on a complex triangulation between constitutional law, European Union law and the European Convention on Human Rights. This had increased not only the quantity of rights but also the number of subjects competent for their protection. This tends to lead to asymmetries of information, overlaps and competition between courts in rights jurisprudences, whose future developments are still uncertain.
