With the legislative project initiated by the Italian Budget Law 2023, l. n. 197/2022, and completed with the so-called Labor Decree, d.l. n. 48/2023, converted into Law n. 85/2023, the discipline of minimum income in the Italian legal system has been structurally reformed. The measure of Citizenship Income has been repealed to make room for the new Reddito di inclusione and Supporto per la formazione e l’impiego. With the new support measure, the number of beneficiaries has been reduced: access conditions and amounts have been modified. Therefore, a social right that is perhaps constitutionally necessary and certainly recommended at the European level has been modified to the detriment, effectively interrupting the path of ius existentiae in Italy. Intersecting the theme of the reversibility of social rights, the purpose of the work is to verify whether the reliance of citizens on legal certainty and specific legal situations, namely the right to the provision of the benefit, has been unreasonably harmed by the new legislation in a negative light.
