The decision of the Appeals Court of Rome not to validate the arrest of Libyan General Al-Masri by the Judicial Police, acting on a warrant from the International Criminal Court, was motivated by the irregularity of the procedure, since there had been no “triggering act” of the Minister of Justice. The contrasting opinion, supported by a significant segment of legal theorists, holds that the procedure in question is entirely “jurisdictionalised” and that, therefore, no triggering act of the Minister was required. According to the latter orientation, the arrest procedure should follow the same rules generally applied to cases of extradition, justifying, inter alia, urgent and prompt action by the Judicial Police. The Author prefers the orientation of the Court of Appeals, for the reasons provided in the relevant Court order and also because of the potential influence the decisions of the ICC can have on relations between sovereign States, which justifies prior acknowledgement by the political authorities and the ensuing triggering act.
