Based on the important nuances that various scholars have identified in the distinction between hermeneutical and testimonial injustice proposed by Miranda Fricker, the author analyses a specific form of epistemic injustice that could affect indigenous women who decide to reject the intervention of indigenous authorities and instead support the intervention of state judges in the prosecution of sexual crimes and domestic violence perpetrated by members of the group to which they belong. In particular, the author suggests, also on the basis of decolonial feminist literature, a risk of whitening and recolonization by the state judicial system through the appropriation of indigenous women’s intra–group resistance, due to the deficient and/or lack of circulation of the hermeneutic resources used by indigenous women to interpret and communicate both the violence they have suffered and the complexity of their sense of belonging to the group.
