This paper critically reexamines the traditional latin maxim ubi societas, ibi ius (“where there is society, there is authority and ius”) by proposing a more historically and conceptually accurate formulation: ubi societas, ibi auctoritas (“where there is society, there is authority”). The distinction emphasizes that law is not an inherent attribute of human coexistence but a product of legitimate authority. Drawing from Roman legal thought and modern constitutional theory, the study argues that law cannot justify itself solely through its existence; rather, its legitimacy must derive from a recognized source of political will. In democratic systems, this source is the popular will as expressed through parliamentary representation. Consequently, the paper defends the thesis that the sole legitimate foundation of law in contemporary societies is democratic authority, not normative formalism or historical continuity.
