Starting from the commentary on the ECTHR judgment of August 28, 2024, this work examines the necessary characteristics for measures stemming from emergency health policies to be considered mandatory for the targeted population. In this context, it analyzes the nature of sanctions and other consequences arising from non-compliance with the prescribed measures, from the perspective of strict legality. The study also delves into the issue of the sovereignty of tyrannical rights and the assessment of productivity and adequacy concerning the achievement of the objectives set by the law mandating compulsory health treatments.
