The article addresses the delicate issue of the protection of human rights in the context of the digitisation of administrative activity. The study begins by analysing the digital transition of public administration in general, and then investigates the compatibility of the use of the algorithm in administrative procedures with the principles expressed by the Italian Constitution and the ECHR. The fundamental charters, which place the human person at the centre of the system, are an indispensable guide for tracing the right balance between the efficiency that technology promises in administrative procedures and the incompressible package of protections that citizens are entitled to when interacting with the p.a. in the so-called §§§§administrative relationship.§§§§ What follows is a synopsis of the developments in Italian jurisprudence concerning the admissibility of algorithms.
