This contribution examines the complex landscape of child labor within digital platforms, focusing on the inadequate protections for minors engaged as content creators or influencers. As the digital economy expands, fueled by the rise of social media platforms, young individuals often find themselves navigating new forms of digital work. While these activities can offer opportunities for skill development and creativity, they also expose minors to potential exploitation and risks to their well-being and educational paths. Thus, the work delves into the legal frameworks that have traditionally governed child labor, highlighting their inadequacy in the digital environment. In addition to providing a brief historical perspective on child labor, it critiques current legal measures and discusses the potential for new rights and protections that could better address the realities of modern child labor in the digital sphere. The article underlines that in 2020, France began legislating specifically around the commercial exploitation of minors’ images on online platforms, emphasizing that similar protections are urgently needed elsewhere, including Italy. Consequently, this work calls for a reevaluation of existing legal frameworks to better safeguard the rights and well-being of young digital workers in the face of rapid technological change and evolving labor markets.
