The subject of this work is the evaluation about the balance between the exercise of the powers granted to police and armed forces and the rights and freedoms established by the European Convention on Human Rights.
This work starts from a general introduction concerning the conventional system and its relation with the national ones.
Next it examines first which kind of rights and freedoms the Convention provides for; besides, how State interference in such rights and freedoms could be deemed as legitimate. Then it analyzes specifically, according to the European Court’s case-law, how the powers that police and armed forces have to exercise could get compatible with the respect of such rights and freedoms.
