La condizione delle madri detenute rappresenta una delle questioni più complesse nel panorama penitenziario italiano e internazionale, ponendo in tensione due diritti fondamentali: da un lato, l’interesse dello Stato a garantire l’esecuzione della pena; dall’altro, il diritto del minore a crescere in un ambiente sereno e familiare. Il presente saggio analizza il fenomeno delle madri detenute in Italia, con un focus sugli ICAM (Istituti a Custodia Attenuata per Madri), integrando una comparazione giuridica con i modelli adottati in Germania, Svezia, Francia e Stati Uniti, e affrontando il tema della decadenza della responsabilità genitoriale e degli strumenti normativi di protezione.

The condition of imprisoned mothers represents one of the most complex issues in the Italian and international penitentiary landscape, putting two fundamental rights in tension: on the one hand, the interest of the State to guarantee the execution of the sentence; on the other, the right of the minor to grow up in a peaceful and familiar environment. This essay analyses the phenomenon of imprisoned mothers in Italy, with a focus on ICAM (Institutes with Attenuated Custody for Mothers), integrating a legal comparison with the models adopted in Germany, Sweden, France and the United States, and addressing the issue of the forfeiture of parental responsibility and the regulatory instruments of protection.
