The paper corresponds to the speech given by the Author (entitled «Unfair terms in consumer contracts: a perspective based on case law, with a special focus on the eu Court of Justice») when participating in the conference «Aktuelle Entwicklungen im EuropĂ€ischen und internationalen zvr» (University of Sassari, 26-27 September 2023): the Author has briefly examined the concept of âunfairâ contractual terms by putting the stress on a number of questions of particular interest, such as the limits surrounding the possible âreplacementâ of such clauses.
