Le droit constitutionnel à la santé a fait l’objet de nombreuses interprétations jurisprudentielles et doctrinales évolutives de 1948 à aujourd’hui. Au stade actuel, même la loi constitutionnelle n° 1 de 2022 sur la protection de l’environnement pourrait entraîner des changements. Ce dernier, en effet, comme tous les amendements constitutionnels – qui sont même inclus parmi les principes fondamentaux – a poussé vers un lien explicite encore plus intense entre la santé et l’environnement, cimentant un réseau entre les principes constitutionnels qui innove le concept de « santé ». Cette notion élargit ses frontières, s’étendant dans l’espace : ne se limitant pas à la protection du bienêtre psycho-physique de la personne mais protégeant aussi ce que la personne vit (ou subit) dans l’espace environnant (environnement et même planète) et même dans le temps : anticipant grandement la phase de prévention. De cette manière, le concept de « OneHealth » a été constitutionnalisé, déjà anticipé au niveau de l’Union européenne et se poursuivant encore plus loin, vers l’approche « Santé Planétaire ». Cela conduit à une ré-innovation du concept de droit constitutionnel de la santé comme résultat de « nouveaux réseaux herméneutiques » entre les principes constitutionnels qui, en cascade, donneront également de nouvelles significations à la production normative ultérieure.

The constitutional right to health has undergone many evolutionary jurisprudential and doctrinal interpretations from 1948 to today. In the current phase, also the constitutional law n. 1 of 2022 on environmental protection can lead to changes. The latter, in fact, like all constitutional amendments - which is even included among the fundamental principles - has pushed towards an even more intense explicit connection between health and the environment, cementing a network between constitutional principles that innovates the concept of “health”. This notion broadens its boundaries, extending into space: not limiting itself to the protection of the person’s psycho-physical well-being but also protecting what the person experiences (or suffers) in the neighboring space (environment and even planet) and even in time: greatly anticipating the prevention phase. In this way, the concept of “OneHealth” was constitutionalized, already anticipated at the European Union level and continuing even further, towards the “Planetary Health” approach. This leads to a re-innovation of the concept of constitutional health law as the result of “new hermeneutic networks” between constitutional principles which then, in cascade, will also give new meanings to subsequent regulatory production.
