Agri-food law offers a peculiar insight to observe the rise of new rights and new techniques to protect people in times of crisis. Indeed, the agri-food market is a complex sector where the length of the supply chain leads to a dispersion of product value that affects the agricultural producer. Moreover, the agricultural producer is often the victim of unfair commercial practices. To protect the §§§§supplier,§§§§ the Italian legislator adopted Legislative Decree No. 198/2021, implementing the minimum harmonisation Directive No. 2019/633/EU on unfair commercial practices in the agri-food chain. The essay analyses the issues related to the ex-post protection tools developed by the legislator, including the provision of ADR instruments and the designation of a new national authority (ICQRF) to ensure the effective enforcement of the prohibitions set forth in Legislative Decree No. 198/2021.
