Technology has an important impact on the relationship between institutions and citizens. The digital dimension is now immanent in the contemporary world and involves the most significant aspects of human experience. The digital space presents public decision-makers with new challenges related to the recognition and regulation of rights related to technology. The positive impact of algorithms and digitalization concerns every social sector: from the medical sector to that of public services. The new Contract Code regulates the digitalization of the entire life cycle of contracts, through the acquisition of data and the creation of native digital documents. That’s why it becomes essential to create interconnection and interoperability between digital platforms. The new Italian administrative legislation moves in harmony with the recent EU Regulation on Artificial Intelligence, establishing in the art. 30 of Legislative Decree no. 36 of 2023 the fundamental principles for the use of automated systems in public procurement, from the principle of algorithmic non-discrimination and algorithmic non-exclusivity, to the principle of humanity.
