This essay analyses the problem of the foundation of human rights in a multicultural context. In particular, the use of human dignity as category to justify human rights causes difficulty, because it often appears as an empty clause, capable of transforming the most varied and contradictory cultural claims into legitimate rights. Through the philosopher Sergio Cotta’s thought, we will try to demonstrate how human dignity is a minimal and not arbitrary normative criterion, able to guide the legislator in the activity of identifying those social instances worthy of being translated into rights.
